How the process of debt collection is carried out

  • The method of collection for debt is different depending on the creditor you have; however, in general, you can expect to see the following happen:
  • You get a notification from their lender that the account you have with them is due. It is usually handled by the collection department in the house of their creditor.
  • their creditor changes their account to the “charge off” status. This usually happens after 180 days without payment. If it’s an account on a credit card, then you’ll lose access to make use of their card. This negative mark remains in their credit file for the next seven years.
  • The debt is then transferred to a collection agency. The creditor employs an agency to get the payment. They may even offer to transfer their loan to the collection agency, which would mean that their creditor is no longer has anything to do with this future process. The only thing you would do is work with the collection agency to repay the amount owed.
  • The collections agency will contact you to confirm their identity. They can do this through telephone or mail — and may even include calling their family, friends, or even their employer to confirm their identity. However, they aren’t legally permitted to discuss their debt with anyone other than you.
  • You’ll receive a written validation notice from the collection agency. After the collector has verified that you are who they say you are, you’ll get a letter within five days, stating the creditor’s name as the initial creditor as well as the amount due and the next steps to take.
  • You continue to receive telephone messages and calls. Until you can pay the debt, the collection agent will contact you via phone and mail correspondence to you.
  • You speak with the collector and agree to pay the amount owed. You can talk to the collector about negotiating to reduce the amount due in this instance.
  • The collector will close their account. Then, when you’ve paid the balance with the collection agency, they will close their account.
